AI Can't Own Patents, Rules UK Supreme Court

The UK Supreme Court made a landmark ruling this week. The ruling came in the case of Dr. Stephen Thaler, who attempted to register patents for two inventions created by his AI system called DABUS (Device for the Autonomous Bootstrapping of Unified Sentience).

Key details:

  • Dr. Thaler's bid to register AI-generated patents was initially rejected by the UK Intellectual Property Office. He appealed to the Supreme Court, which unanimously ruled against him

  • The ruling states AI systems cannot be considered inventors under current UK patent law, which defines an inventor as a natural person

  • The court did not rule out the possibility of expanding the patent system in the future to accommodate technical advances generated by autonomously acting machines powered by AI

  • Dr. Thaler previously lost a similar case in the US, where the Supreme Court declined to hear his challenge to the Patent Office's refusal

The ruling currently maintains human inventors at the center of the patent system, as AI is currently regarded as a tool rather than an agent, and that's not likely to change in the near future.
